RULES FOR SALE AND USE OF TTSWTRS GIFT CERTIFICATES IN TTSWTRS WORLDWIDE ONLINE STORE
1. These Rules for the use of TTSWTRS gift certificates (hereinafter referred to as the "Rules") regulate the conditions of purchase and use of TTSWTRS gift certificates purchased in the TTSWTRS WORLDWIDE online store at the link Gift Card and applicable to all countries of the world, except Ukraine, Poland and Austria.
2. DEFINITION OF TERMS:
2.1. TTSWTRS - within the meaning of these Rules, a duly registered business entity that uses the TTSWTRSⓇ mark for goods and services on the territory of Ukraine on the basis of license agreements with the right holder and sells goods under the TTSWTRS Ⓡ mark for goods and services and is a seller of Gift Certificates (further on text “TTSWTRS”).
2.2. TTSWTRS Gift Certificate (hereinafter - Gift Certificate) within the meaning of these rules is a Gift Certificate purchased in the TTSWTRS WORLDWIDE online store, which is an intangible medium visualized in electronic form as an information message with a unique code, nominal value and validity period of the Gift Certificate, which during the validity period entitles the consumer/bearer to receive goods - clothes and items of the TTSWTRS brand in TTSWTRS WORLDWIDE online store (by specifying the unique code of the Gift Certificate when placing an order in the TTSWTRS WORLDWIDE online store), from the assortment and at the price valid at the time of receipt of the goods, for a total value equal to the nominal value of the Gift Certificate.
2.3. The purchase of a Gift Certificate is the payment of cash in the amount equal to the nominal value of the Gift Certificate, and is a preliminary payment for the purchase of goods that will be transferred to the Holder of the Gift Certificate in the future.
2.4. TTSWTRS WORLDWIDE online store: TTSWTRS website at https://www.ttswtrs.com.
3. TERMS OF PURCHASE, USE AND RETURN OF GIFT CERTIFICATE
3.1. The owner of the Gift Certificate is the relevant TTSWTRS store. The consumer/bearer of the certificate is its user.
3.2. A Gift Certificate is not a payment document or a security.
3.3. The Gift Voucher can be purchased through bank transfer.
3.4. Nominal value of the Gift Certificate: indicated in USD, in the information message received from the TTSWTRS WORLDWIDE online store after purchasing and paying for the Gift Certificate and is equal to its value.
3.5. Gift Certificates are available for purchase at the TTSWTRS WORLDWIDE online store.
3.6. When purchasing a Gift Certificate, in addition to the Gift Certificate itself, the TTSWTRS WORLDWIDE store issues a corresponding financial document for the amount of the paid funds to the consumer.
3.7. The validity period of the Gift Certificate is 1 (one) year from the moment (date and time) of its purchase.
3.8. If during the Gift Certificate validity, the right to receive goods within the nominal value thereof is not exercised, then the obligation of the TTSWTRS store where the Gift Voucher was purchased or another legal entity to which the merchandise debt was transferred to release goods against the nominal value of the Gift Certificate shall be terminated, and the amount paid for the Gift Certificate shall remain at the disposal of a relevant TTSWTRS store where the Gift Certificate was purchased or another legal entity to which the merchandise debt was transferred, and non-refundable.
3.9. The Gift holder loses the right to use it in accordance with these Rules from 00:00 on the date following the last day of validity of the Gift Certificate.
3.10. The Gift Certificate can be used only once during the transaction for one fiscal check. To exercise the right to receive goods within the nominal value of the Gift Certificate, a person must activate its unique code in the shopping cart when purchasing goods online in the TTSWTRS WORLDWIDE online store.
3.11. The Gift Certificate is a holder document: the Gift Certificate can be used both by the person who personally purchased it and any other person who activate its unique code in the shopping cart when purchasing goods online at the TTSWTRS WORLDWIDE online store.
3.12. The value of the product must be equal to or exceed the nominal value of the Gift Certificate. If the value of the goods exceeds the nominal value of the Gift Certificate, its holder shall pay the difference between the nominal value of the Gift Certificate and the value of the goods through bank transfer. If the amount of the receipt and/or order is less than the nominal value, the remaining nominal value of the Gift Certificate is neither refundable nor retainable. A Gift Certificate can be used only once, the unused amount of the Gift Certificate cannot be transferred to other purchases.
3.13. The exchange and return of goods purchased using a Gift Certificate are carried out in accordance with the general procedure provided for by the current legislation of Ukraine on the protection of consumer rights.
3.14. The Gift Certificate is not subject to return or exchange for a cash equivalent, except for the legal right of the consumer to refuse the purchased product, defined in clause 3.15. of these Rules.
3.15. The buyer of the Gift Certificate has the right to return the Gift Certificate within the framework of the current legislation on the protection of consumer rights, using the legal right to refuse the goods within 14 (fourteen) calendar days, similarly to other goods. To exercise this right, the Buyer must present to the manager of the TTSWTRS WORLDWIDE online store a confirmation of the purchase of the Gift Certificate (the relevant financial document for payment). Money paid for a Gift Certificate, should the Buyer want to exercise his or her legal right to refuse, as specified in this clause of the Rules, can be refunded in the same way as the same was purchased - – through bank transfer. In other cases, except as described in clause 3.15. of the Rules, the Gift Certificate cannot be refunded or exchanged for a monetary equivalent.
3.16. A Gift voucher is a holder document. If the Gift Certificate is lost, the Gift Certificate and its unique activation code cannot be restored. TTSWTRS is not responsible for the security and confidentiality of the data of the unique code of the Gift Certificate after the sale of the Gift Certificate.
3.17. TTSWTRS Stores Administration reserves the right not to accept the Gift Voucher in the following cases:
3.17.1. When there are any doubts as to the validity thereof, whereof it shall be immediately reported to the holder of the latter.
3.17.2. Presenting the Gift Certificate at an offline TTSWTRS store or at a TTSWTRS online store other than the TTSWTRS WORLDWIDE online store. In this case, the Holder/Owner (consumer) has the right to present the Gift Certificate in the TTSWTRS WORLDWIDE store in accordance with the current Rules for the sale and use of TTSWTRS Gift Certificates in the TTSWTRS WORLDWIDE store .
3.18. The purchase of a Gift Certificate indicates payment by the owner of the Gift Certificate of its value, as the nominal value of the Gift Certificate, specified in the information notice on the purchase of the virtual Gift Certificate, which is confirmed by the relevant financial document;
3.18.3. That the Gift Certificate buyer/consumer/holder has duly read and granted his or her consent to comply with these Rules.
3.19. The Gift Certificate holder agrees to transfer the merchandise debt of the seller of this Gift Certificate to another business entity (natural person - entrepreneur or legal entity).
3.20. These Rules may be changed by TTSWTRS unilaterally by updating them on the TTSWTRS WORLDWIDE website, without prior notice to the Holders/Owners of the Gift Certificates.
3.21. The purchase and/or use of a Gift Certificate indicates that the Owner/Holder has read and agreed to these Rules.
